Before me John Rosenheimer, a Notary public and for the County of Bexar, and State of Texas

Personally appeared Matias Carillo, a resident Citizen of Bexar Co. to me well known, who being duly sworn under his oath, affirms and attest that he was born at San-Antonio, of Texian parents, in the year 1806, and that he has resided during all his life either at said place, all on his farm, on the Medina river, Bexar Co.

That, in the year 1828 affiant married at San-Antonio Teodora Ximenes (sic) Mireles, also a daughter of this Country.

That, in the year 1835 he was a married man and the head of a family with two Children.

That, in the month of October 1835, affiant was one of the first Mexicans who answered the call of Capt. John N. Seguin, for independence, that he was one of the 37 volunteers who joined the Texian patriots on the Salado Creek; that he fought at the battle of Concepcion, and took an active part in the besieging and storming of Bexar, that over more he furnished his cart and oxen, for the service of the Camp;

That at the Storming of the aforesaid place, he entered the City, with a detachment of his fellow-soldiers, under the immediate command of Capt. Don Refugio de Leon, by the Street of Las Flores and participated in the attack of the Houses of Luciano Navarro, and of Angel Navarro, and did continue to fight, till the Capitulation of General Cos,

That, a few days after, the service of the volunteers, being no more of an immediate need, affiant received from James Bowie and Ben Travis the authority to leave the service, and to attend to the protection and security of his family, which he did; affiant remained at home since then; but at the coming of General Woll, affiant shouldered again his musket, and joined the Company of T. W. Smith and Salvador Flores, both deceased, for the defense of the City.

Affiant attest that he is the same man who rendered the aforesaid military service, and he never aided or assisted directly or indirectly the enemy of this Country; he therefore considers himself justly entitled to apply for the military pension granted by law to the surviving veterans of the revolutionary war, and to that effect he constitutes hereby for his Attorney in fact, David W. Whiting of the City of Austin, in order that he may present, urge and receive in his name, any bond, Certificate or any other document delivered by the proper authority in favor of affiant, and to give sufficient discharge for the same.

Before me Jno. Rosenheimer a notary public in and for said County & State personally appeared Col John N. Seguin who having been duly sworn by me upon his oath declares and affirms that Matias Carillo, the foregoing affiant, was born at San Antonio of Texian parents and is of the same age of affiant; it is about 69 years of age; that affiant was one of the first volunteers who joined the Texian troops in October 1835 on the Salado creek; and joined the Company of Witness; that he fought at the battle of Concepcion, followed him in the volunteer service during the siege of Bexar and took an active part in the assaulting of the place; that after the taking of Bexar and in the month of January 1836, said Carillo having a wife and family to support and protect, received the authorization of to return what he did; Witness knew nothing about the posterior military of Matias Carillo, who has always resided in the Country, but witness never learned or heard that said Carillo aided the enemy of the Country, directly or indirectly. Petitioner is the identical person who rendered the military service aforesaid in the Company and under the Command of the Witness.

Before me John Rosenheimer a notary public in and for said county & state personally appeared Juan Ximenez to me well known who having been duly sworn by me under his oath declares and affirms that he knows Matias Carillo, ever since he recollects; that said Carillo was born at San Antonio where he has resided all his life, and some time on his rancho on the Medina river; that at the time of the revolutionary war against Mexicos, Carillo served as a private in as above stated; that he joined the Texian Troops at the Salado Creek, took part in the battle of Concepcion and in the siege and taking of Bexar; that he was authorized after the rendition of said place to return home to attend to his family. Witness affirms that petitioner

is the same and identical person who rendered the Military service aforesaid; he never heard that Matias Carillo aided or assisted directly or indirectly the enemy.

Know all men by these present that I, Matias Carillo of the County of Bexar, State of Texas, do hereby Constitute and appoint D. V. Whiting of the County of Travis, State of Texas, my attorney in fact, with authority for me and in my name to appear before all Courts, Boards or Competent authorities, and to apply, ask for, demand, the Military Pension to which I am justly entitled under the laws of the State as one of the surviving Veterans of the War that separated Texas from Mexico; to receive all money, State Bonds or Warrants or other title establishing my right and entitling me to the aforesaid Military Pension, to receive the same, and for me and in my name to execute and deliver proper acquittance and receipts, further to furnish all proofs establishing the justice of my right, and if necessary to procure and produce all additional proofs if any are required and generally to do and perform all and every act and deed in the premises as I might lawfully do if personally present, and acting for myself, giving him full power of substitution. Hereby ratifying and Confirming all that my said attorney or his substitute may do and cause to be done, to obtain my said Pension, declaring that I am the same and Identical person who performed the Military Service for which a pension claimed is granted by the State of Texas.

County Court Bexar County.
To the Honorable Thos. A. Dwyer Judge

The applicant Matias Carillo, aged 68 years, a resident of said County, with respect represents that he believes himself entitled to the benefit under the law granting annual Pensions, approved 28th of July A.D. 1876.

That he was a volunteer soldier in the Army of the Republic of Texas, and served in the war between Texas and Mexico between the commencement of the revolution in 1835, and the first of January 1837.

That he was in the Company of Salvador Flores at the siege of Bexar, and was present at the surrender of Genl. Cos in December 1835, and otherwise always with, and never against the Americans; that he made proof of Service under the former law and received Bonds, as will appear in the Public Archives at Austin.

He further represents that he is in indigent circumstances.

He therefore prays that this application be received and entered of record, and notice given as required by law to entitle him to receive the benefits of the same.

He appoints Edward Miles, his attorney in fact to present his claim and to receive the certificate when granted and the payments, as they may become due.
